Assessment of Decision-Making Capacity

Decision-making capacity refers to a person’s cognitive ability to understand information, appreciate consequences reason through options and communicate choices. Capacity is decision specific and can vary depending on the complexity of the choice at hand someone might retain capacity for simple daily decisions while lacking capacity for complex financial or medical matters.

Dr. Fox is often consulted to perform decision-making capacity assessments from concern family members, attorneys, medical professionals and the probate court.

For disabled or intellectually impaired minors who are reaching 18 years of age.

To establish testamentary capacity and  the ability to execute a trust or power of attorney.

To provide a health professionals report that is required by the probate court in guardianship proceedings.

To to establish the potential for a restoration of rights for those who no longer need a guardian.
